It would vary according to your location, what city, town, or county organization would be in charge of that decision so I cannot give you a hard and fast absolute answer. However, I would say that unless you live well out in the country, outside of any zoning or planning commissions jurisdiction - I'm almost sure the answer will be yes. Not only will you need their permission, but I bet you will also be required to hire a licensed contractor to do the work.
